Terms and Conditions

Acceptance of Terms

  • Agreement: These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and GeoTraq ("we," "us," or "our"). By downloading, installing, or using the GeoTraq mobile application ("the App"), you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the App.
  • Updates: We may update these Terms from time to time, and any changes will be effective immediately upon posting. Your continued use of the App after any such modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms regularly.

License and Use

  • Grant of License: Subject to your compliance with these Terms, GeoTraq grants you a limited, non-exclusive, revocable, and non-transferable license to download, install, and use the App for personal and non-commercial purposes on your mobile device.
  • Restrictions: You may not modify, distribute, reproduce, or create derivative works based on the App. Unauthorized use may result in the termination of your account and legal action.

User Accounts

  • Account Creation: Certain features of the App may require you to create a user account. You agree to provide accurate, current, and complete information during the registration process.
  • Account Security: You are responsible for maintaining the confidentiality of your account information, including your password. You are liable for all activities that occur under your account.
  • Account Termination: GeoTraq reserves the right to suspend or terminate accounts for any violation of these Terms or for any other reason.

Subscriptions and Payments

  • Subscription Plans: GeoTraq offers optional auto-renewable subscriptions (such as the One Month Plan) that unlock premium features. The plan name, duration and price are shown in the App before purchase.
  • Payment: Payment is charged to your Apple ID account at confirmation of purchase.
  • Auto-Renewal: Your subscription renews automatically at the same price and duration unless it is cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Managing and Cancelling: You can manage or cancel your subscription at any time in your App Store account settings (Settings > your name > Subscriptions). Cancellation takes effect at the end of the current billing period.
  • Refunds: Payments are processed by Apple. Refund requests are handled by Apple according to its policies at reportaproblem.apple.com.
  • Free Trials: If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription.
  • Price Changes: We may change subscription prices. Apple will notify you in advance and, where required, ask for your consent before a price increase applies.

Apple App Store Terms

  • Apple Standard EULA: If you downloaded the App from the Apple App Store, your use of the App is also subject to Apple's Licensed Application End User License Agreement. In case of conflict, these Terms apply to the extent permitted by Apple's terms.
  • Apple Is Not Responsible: These Terms are between you and GeoTraq only, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for the App.

Privacy

  • Privacy Policy: Your use of the App is also governed by our Privacy Policy, which outlines how we collect, use, and share your information. You can review our Privacy Policy here.
  • Consent to Data Practices: By using the App, you consent to the collection, use, and sharing of your information in accordance with our Privacy Policy.

Location and Tracking Services

  • Location-Based Features: The App includes features that involve tracking and location services. These features may use GPS, Wi-Fi, or mobile network location information to determine your device's approximate location. Always location lets approved people follow you when the App is closed. Both sides must consent. You can pause sharing, set hours, or stop at any time.
  • Location Push: If an approved watcher opens Tracking and your last trusted location is old, the App may use Apple Location Push so a locked or backgrounded iPhone can send one fresh point. This is recovery only, not continuous tracking.
  • Location Data Accuracy: While we strive to provide accurate location data, we do not guarantee the accuracy, completeness, or reliability of location information. You acknowledge that your use of location-based features is at your own risk.
  • Consent to Location Data Use: By using location-based features, you consent to the collection and use of your location data as described in our Privacy Policy.

User-Generated Content

  • Content Submission: You may have the opportunity to submit content, including but not limited to GeoPhotos, trip details, and comments ("User Content").
  • User Content License: By submitting User Content, you grant GeoTraq a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, distribute, and display the User Content in connection with the App.
  • User Content Ownership: You retain ownership of your User Content. GeoTraq does not claim any ownership rights in your User Content.

Account Deletion

You have the option to delete your account within the App. By choosing to delete your account, you understand and agree that:

  • All Data Deleted: All data associated with your account, including but not limited to trip details, GeoPhotos, and personal information, will be permanently deleted from our servers.
  • Irreversible Process: Account deletion is an irreversible process, and you will not be able to recover any data once the deletion is complete.
  • Termination of Services: You will no longer have access to the services and features provided by GeoTraq after the account deletion.

Confirmatory Action

To initiate the account deletion process, you may be required to confirm your intent through a confirmatory action within the App. This step is designed to prevent accidental or unauthorized account deletions.

Timing of Deletion

The account deletion process may take a reasonable amount of time to complete. During this period, your data will not be accessible, but it may still exist in our backup systems. However, it will be permanently deleted in due course.

Termination

  • Termination Rights: GeoTraq reserves the right to terminate or suspend your access to the App at any time, with or without cause and with or without notice.
  • Consequences of Termination: Termination may result in the loss of data associated with your account. Provisions of these Terms that, by their nature, should survive termination will survive.

Changes to Terms

  • Modification: GeoTraq may modify these Terms at any time. Changes become effective upon posting
  • Notification of Changes: We may provide notification of significant changes. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
